{"id":405,"date":"2013-09-12T16:13:02","date_gmt":"2013-09-12T16:13:02","guid":{"rendered":"http:\/\/bankruptcyattorneystl.com\/?p=405"},"modified":"2013-09-12T16:13:36","modified_gmt":"2013-09-12T16:13:36","slug":"what-is-an-automatic-stay-in-bankruptcy","status":"publish","type":"post","link":"http:\/\/bankruptcyattorneystl.com\/?p=405","title":{"rendered":"What is the Automatic Stay?"},"content":{"rendered":"<p>In Bankruptcy, an automatic stay protects a debtor from his or her creditors.\u00a0 The automatic stay prevents a creditor from collecting on debts incurred by the debtor.\u00a0 The automatic stay is effective immediately upon the filing of the bankruptcy.\u00a0 As soon as the bankruptcy is filed and a case number is obtained, creditors may no longer pursue judgments, garnishments, foreclosure proceeding, or repossessions.\u00a0 Creditors also must cease all phone calls, letters, e-mails, and any other form of communication with the debtor.\u00a0 It is not legal for them to continue attempts to collect on any debts.<\/p>\n<p>While this automatic stay goes into effect immediately, some of your creditors can ask the court for permission to continue collections. Secured creditors can ask the court for a motion for relief from the automatic stay.\u00a0 A secured creditor has a claim on a debt that is secured by collateral, such as a mortgage on a home or a loan on a vehicle.\u00a0 If a debtor is not current on their secured debts, the creditor can file a motion for relief from automatic stay with the bankruptcy court.\u00a0 You must continue making payments on secured debts while in a bankruptcy if you want to keep the collateral.\u00a0 If you do not remain current, the creditor will file the Motion for relief with the court.\u00a0 \u00a0When a motion for relief is filed, if the debtor does not become current or make arrangements with the secured creditor, the court can grant the motion for relief.\u00a0 When that is granted, that gives the secured creditor permission to repossess or foreclose on the property.\u00a0\u00a0 The debtor is then no longer protected by the automatic stay from those particular creditors.<\/p>\n<p>There are exceptions to the automatic stay.\u00a0 For example, if a debtor is in a situation where their landlord gets a rent and possession judgment against them for rent before the filing of the bankruptcy, that is not protected by the automatic stay.\u00a0 The automatic stay has certain limitations.\u00a0 If a debtor has had more than one bankruptcy case pending in the one year prior to the filing of the current bankruptcy, their automatic stay is limited to 30 days.\u00a0 The debtor would have to file a motion to extend the automatic stay in order for it to last the entirety of the bankruptcy, and that motion would state why circumstances are different with this bankruptcy and that it was filed in good faith.\u00a0 If two or more bankruptcies have been pending in the last year, there is no automatic stay.\u00a0 You can request that the automatic stay be imposed, but the court will have to decide that, and your creditors can object to that being allowed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Bankruptcy, an automatic stay protects a debtor from his or her creditors.\u00a0 The automatic stay prevents a creditor from collecting on debts incurred by the debtor.\u00a0 The automatic stay is effective immediately upon the filing of the bankruptcy.\u00a0 As &hellip; <a class=\"more-link\" href=\"http:\/\/bankruptcyattorneystl.com\/?p=405\">Continue reading <span class=\"meta-nav\">&rarr;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5,24,3,53,8,7,34,58],"tags":[],"class_list":["post-405","post","type-post","status-publish","format-standard","hentry","category-automatic-stay","category-bankruptcy-filing","category-bankruptcy-general","category-chapter-13-bankruptcy","category-chapter-7-bankruptcy","category-collection-harassment","category-foreclosure","category-secured-property"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>What is the Automatic Stay?
